Indemnity Agreement

1. Acceptance of Terms

By making a reservation at Bushbuck Farm Eco-Retreat (“the Property”), you, the guest (“the Guest”), acknowledge that you have read, understood, and agree to abide by the terms and conditions set forth in this Indemnity Agreement.

2. Assumption of Risk

The Guest acknowledges that engaging in recreational activities offered by the Property, such as hiking, kayaking, canoeing, or using any of the facilities, carries inherent risks. These risks may include but are not limited to personal injury, property damage, encounters with wildlife, or other unforeseen hazards.

3. Waiver and Release of Liability

The Guest hereby agrees to release and discharge Bushbuck Farm Eco-Retreat, its owners, employees, agents, and representatives from any liability, claims, or demands for any loss, damage, or injury, including death, that may occur during their stay or while using any of the Property’s facilities or equipment. This waiver applies to all causes of action, whether arising from negligence or otherwise, to the fullest extent permitted by South African law.

4. Indemnification

The Guest agrees to indemnify and hold Bushbuck Farm Eco-Retreat, its owners, employees, and agents harmless against any claims, damages, costs, or expenses (including legal fees) arising out of or in connection with the Guest’s stay at the Property or use of its facilities, equipment, or trails.

5. Guest Responsibility

The Guest acknowledges that they are responsible for their safety and the safety of any minors or individuals under their supervision. The Guest agrees to follow all safety guidelines and instructions provided by the Property and to use facilities and equipment in a responsible manner.

6. Use of Facilities and Equipment

The Guest agrees that the use of hiking trails, watercraft (such as kayaks and canoes), and any other recreational equipment provided by the Property is entirely at their own risk. The Guest agrees to wear appropriate safety gear and take necessary precautions during all activities.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising hereunder shall be subject to the jurisdiction of the courts of South Africa.

8. Agreement to Terms

By confirming a reservation at Bushbuck Farm Eco-Retreat via this website or any other booking platform, the Guest acknowledges that they have read, understood, and agreed to the terms and conditions of this Indemnity Agreement.
